Publicis Groupe (“Publicis” or “We”) publishes this website www.marcel.ai/oa (“Website”) to provide information about the Open Apprenticeship Program (the “Apprenticeship Program”) and provide content and services to individuals interested in participating in the Apprenticeship Program.
By using this Website and participating in the Apprenticeship Program, including using all features, functionalities, content and software applications associated with the Website and the Apprenticeship Program (collectively the ”Content”), you are entering into a binding contract with us and you agree to comply with the general terms and conditions of access and use described in detail below the “T&Cs”) and the laws applicable in France, especially related to online communications.
All users of this Website participating in the Apprenticeship Program are subject to the following T&Cs, which may be subject to special terms and conditions when applicable. In order to use the Website, participate in the Apprenticeship Program and access any of its Content, you need to (1) meet the minimum age of 18, and (2) have the power to enter into a binding contract with us and not be barred from doing so under any applicable laws. 2 – Creative Ownership
Publicis Groupe may publish on this Website and as part of the Apprenticeship Program creative briefs inviting users of this Website participating in the Apprenticeship Program to propose original, unpublished works (hereafter the "Works"). By registering on this Website and proposing Works in response to briefs published by Publicis Groupe, the participants of the Apprenticeship Program (hereinafter the "Authors") agree that: (1) Publicis Groupe shall own all intellectual property rights and any and all “Moral Rights” in and to all “Works” as hereinafter defined. To the fullest extent permitted by law, all Works shall belong to Publicis Groupe and shall be considered a work made for hire for Publicis Groupe; (2) to the extent Publicis Groupe does not own any Work as a work made for hire or to the extent you may have any Moral Rights in and to any Works under any applicable law, the participants of the Apprenticeship Program shall progressively assign to Publicis Groupe all intellectual property rights to the Works of which they are the Authors as they send the said Works as a response to a creative brief published on the Website. Such assignment shall include, but not be limited to, all reproduction, distribution, and public display rights, with no limitation on the use of such rights and for the full period of copyright protection under international copyright conventions. Such assignment shall allow Publicis Groupe or its affiliates to reproduce, perform and adapt the Works in any format, on any data carriers and via any media, whether known or presently unknown, anywhere in the world, for any Publicis Groupe clients and in any communication campaign disseminated by any means whatsoever.
In the event that the intellectual property rights (copyrights and similar rights, particularly rights to trademarks, designs and models) are related to preliminary versions and are not the property of the Author, the Authors hereby agree to specify the source of the borrowed or adapted works in a note attached to the submitted Works. The Authors shall mention the name of the author(s) of the first work incorporated into their Work (e.g., the name of the composer of a musical work) and, if possible, the year of original publication of the said work. In that way, if Publicis Groupe wishes to produce the Work for the purposes of one of its advertiser clients, Publicis Groupe may negotiate with the relevant rights-holders in order to obtain the authorizations and assignments of rights necessary for unchallenged exploitation of the Works.
The above-mentioned assignment of rights shall be granted exclusively to Publicis Groupe and the companies thereof and the participants agree to refrain from granting any rights of the same kind to third parties.
“Works” as used herein means all work product, inventions, and works of authorship created or developed and proposed by the participants of the Apprenticeship Program as a response to a creative brief published on the Website, including, but not limited to, any and all copy, art, music, slogans, trademarks, service marks, product ideas, inventions, and any and all advertising and promotional ideas and/or intellectual property, computer software, writings (including reports, source and object codes, manuals and other documentation), discoveries, inventions, improvements, ideas and “know-how,” drawings, names, models, trademarks, innovations, and contributions, regardless of what form they may take, and whether or not patentable or copyrightable, which relate directly or indirectly to Publicis Groupe, or any clients of Publicis Groupe. Where permitted under applicable laws, such Works are and shall remain the sole and exclusive property of Publicis Groupe (and its successors and assigns).
“Moral Rights” means rights of authors of Works in countries where such rights are recognized which are in addition to, or in lieu of, copyrights and other intellectual property rights, including rights to claim authorship of Works and to object to any distortion, mutilation or other modification of, or other derogatory action in relation to, Works.
3 – Hyperlinks
Publicis Groupe shall under no circumstances be held liable for providing access to third-party websites via hyperlinks on the present Website and shall not be held liable for the contents, products, services, etc., available on the said websites or via the said websites which are governed by said websites’ own terms and conditions and privacy policies.
4 – Disclaimers
Except if otherwise indicated, the Website is intended for users’ personal use only and shall not be accessed for commercial purposes.
Publicis, as well as the hosting provider, and, more generally, any company contributing to the design, implementation and online publishing of this Website make every effort to ensure the accuracy and regular updating of the information broadcasted on this Website.
